Public Offer Agreement
1. GENERAL PROVISIONS
1.1. This Public Offer is an official proposal by the Seller to any legally capable individual to enter into a distance sales agreement via the online store on the website https://ethnograce.com/
under the terms set forth herein.
1.2. Goods or Services – items selected by the Buyer on the website and added to the cart or purchased remotely.
1.3. Online Store – the Seller’s website https://ethnograce.com/
, created for concluding purchase agreements based on the Buyer’s review of product descriptions presented online.
1.4. Buyer – any legally capable individual who voluntarily accepts these Terms in full.
1.5. Seller – an individual entrepreneur or legal entity responsible for offering and delivering the Goods presented on the website. Full legal details are provided in purchase documents and on product pages.
1.6. The Seller operates in accordance with the legislation of Ukraine, including the Law of Ukraine “On Consumer Protection.”
1.7. By placing an order, the Buyer confirms that they have read, understood, and agreed to these Terms.
2. TERMS AND DEFINITIONS
2.1. Within this Agreement:
Goods – clothing, accessories, and related products;
Seller – the entity selling Goods via the website;
Buyer – an individual making a purchase by accepting these Terms;
Order – a selection of Goods chosen, confirmed, and paid for by the Buyer.
3. SUBJECT OF THE AGREEMENT
3.1. The Seller agrees to transfer the Goods to the Buyer, and the Buyer agrees to accept and pay for them under the terms of this Agreement.
This Agreement governs:
the process of selecting, ordering, and paying for Goods;
delivery terms;
rights and obligations of the parties.
4. ORDER PLACEMENT PROCEDURE
4.1. An order may include any Goods available on the website.
4.2. Goods may be selected in any available quantity.
4.3. If a product is unavailable, a representative will contact the Buyer via phone or email.
4.4. The Buyer may choose a replacement product.
4.5. Orders are placed via the “Cart” section on the website.
4.6. An order is considered valid if the Buyer provides accurate personal data, delivery address, contact phone number, email, payment method, and delivery type.
5. ORDER CONFIRMATION
5.1. The online store confirms product availability and contacts the Buyer to уточнить details.
5.2. After confirmation, changes or cancellations are possible only before payment. After payment, changes or cancellations are not permitted.
6. ORDER PROCESSING
6.1. Orders confirmed before 14:00 (Kyiv time) are usually shipped the same business day. Orders placed on weekends or holidays are processed on the next business day. Dispatch location: Ukraine.
6.2. If a product is unavailable, the Seller informs the Buyer and offers alternatives.
6.3. After processing, the Buyer receives order status updates and payment instructions via email.
7. PAYMENT METHODS
7.1. Available payment methods:
Online card payment
WayForPay or other supported payment services
7.2. All fees, including cash-on-delivery and payment processing fees, are covered by the Buyer unless stated otherwise.
8. DELIVERY TERMS
8.1. Delivery within Ukraine is carried out by Nova Poshta. International delivery is handled by Ukrposhta or other courier services. Delivery to Russia and Belarus is not available.
8.2. Delivery obligations are considered fulfilled once the Goods are handed over to the carrier. Risk transfers to the Buyer at the moment of shipment.
8.3. Free delivery within Ukraine may be available for standard retail orders. Promotional items may be excluded.
8.4. Additional delivery charges may apply to accessories, promotional items, or charity products.
8.5. Goods within one order may be shipped separately at the Seller’s discretion.
8.6. Orders are shipped within 1–3 business days after confirmation, subject to product availability.
9. RETURN POLICY
9.1. Returns are processed at the original place of purchase.
9.2. Goods of proper quality may be returned or exchanged within 14 days, provided they are unused, unworn, undamaged, and retain original tags and packaging.
9.3. Goods without packaging, tags, or showing signs of use, wear, damage, or alteration are not eligible for return.
9.4. Returns are accepted upon completion of a return request form and shipment to the specified address.
10. RIGHTS AND OBLIGATIONS
The Seller must fulfill orders in accordance with this Agreement.
The Buyer must provide accurate information and complete payment on time.
The Buyer is responsible for checking the Goods and quantity before payment.
11. PRIVACY AND DATA PROTECTION
Personal data is processed in accordance with the Privacy Policy published on the website https://ethnograce.com/

12. TERM AND MODIFICATIONS
12.1. The electronic agreement is considered concluded upon acceptance by the Buyer in accordance with the Law of Ukraine “On Electronic Commerce.”
12.2. Termination of the agreement is possible only by mutual consent before payment.
12.3. The Seller reserves the right to modify these Terms at any time by updating them on the website.
